Terms of Service

1. Definitions​

These Terms of Use (hereinafter referred to as the "Terms") govern the EnkorStay website and application operated by EnkorWithUs, a registered legal entity in Korea. These Terms constitute a legally binding agreement between EnkorStay (hereinafter referred to as "we," "us," "our," or "Company") and users accessing and using the services provided on the EnkorStay platform, including those provided by third-party operators (hereinafter "Host" or "Operator"). Please read these Terms carefully before using the services.

The EnkorStay platform provides an online space for users to post, offer, search, and book services. Members offering services are referred to as "Hosts" or "Operators," while members booking and using services are "Guests." Hosts may provide accommodations ("Accommodations"), activities, tours, events ("Experiences"), visa or ARC services ("Visa Services"), and other travel-related services (collectively, "Host Services"). To access various features of the platform, users must register an account and maintain accurate account information.

As the platform provider, EnkorStay does not own, control, or manage any Host Services and disclaims any responsibility for damages related to those services. EnkorStay does not act as a real estate agent or insurer, and it is not a party to agreements between Hosts and Guests. The Host is responsible for ensuring compliance with all applicable laws, regulations, and agreements with third parties concerning the services they provide.

2. Modifications to the Terms​

2.1.1 The Company reserves the right to modify these Terms at any time without prior notice. Users should regularly review this page to stay informed about the current version of the Terms. Updates will be posted on this page, with the last modification date displayed at the bottom.

2.1.2 Continued use of the platform after modifications constitutes acceptance of the revised Terms. It is the user's responsibility to review any changes.

2.1.3 In addition to these Terms, users agree to comply with any other terms or policies adopted by the Company from time to time, including the Privacy Policy.

3. EnkorStay’s Role​

3.1.1 Mission

Our mission is to provide comfortable stays throughout Korea. Users can explore listings ranging from studios to hotels and independent homes to find accommodations that fit their lifestyle. Review descriptions, photos, and Host profiles to learn more about listings, and message Hosts directly for additional inquiries.

3.1.2 Role of EnkorStay

EnkorStay provides the platform for Hosts to list, offer, search, and book services. While we strive to offer the best experience, we cannot control the actions of Hosts or Guests. EnkorStay may monitor platform use but is not obligated to do so. Content that violates these Terms may be blocked, edited, or removed at our discretion to maintain the platform’s quality and compliance.

4. Searching and Booking on EnkorStay​

4.1 Search and Filters

Users can search by accommodation type, proximity to universities, and other criteria. Filters enhance search precision. Search results are based on relevance, availability, and other factors such as minimum/maximum stay requirements or popularity. EnkorStay may periodically test different search algorithms to improve user experience.

4.2 Booking and Payment

When making a booking, users agree to pay the total fees (collectively, "Total Fees"), including service fees and applicable taxes. Upon booking confirmation, a direct contract is established between the Host and Guest, governed by the Host's policies and terms. EnkorStay collects security deposits as required by the Host.

5. Cancellations, Travel Issues, Refunds, and Booking Changes​

5.1 Cancellations and Refunds

Cancellations are subject to our Guest Policy. In cases of uncontrollable events, partial or full refunds may be available. If a Host cancels a booking or a travel issue arises, Guests may be eligible for rebooking or a refund.

5.2 Booking Changes

Hosts and Guests may modify bookings through the platform, with any resulting fees or taxes to be paid accordingly.

6. Access and Use of Services​

Users are responsible for ensuring access to the platform and complying with the applicable terms. The Company reserves the right to modify, suspend, or discontinue any aspect of the platform.

7. Member Responsibilities and Risk Assumption​

Users are accountable for their actions and those of their invitees. Participation in activities carries inherent risks, which members voluntarily assume when using the platform.

8. Content Use​

All materials on the platform are protected by intellectual property rights. Unauthorized use of content is prohibited.

9. Intellectual Property​

The platform and its contents are protected by copyright and other intellectual property laws. Users must not reproduce, modify, or distribute any part of the platform without permission.

10. User Representations and Warranties​

Users must comply with all applicable laws and avoid engaging in harmful or illegal activities. EnkorStay reserves the right to remove user-generated content that violates these Terms.

11. Account Registration and Security​

Users must provide accurate information and maintain the confidentiality of their account credentials. The Company may terminate accounts that violate these Terms.

12. Reviews and User Content​

By submitting content, users grant EnkorStay a perpetual, royalty-free license to use, edit, or remove it. Reviews must adhere to content guidelines.

13. EnkorStay’s Rights and Responsibilities​

The Company retains discretion over platform content and policies and may modify services or fees at any time.

14. Indemnification​

Users agree to indemnify EnkorStay against claims arising from violations of these Terms or misuse of the platform.

15. Disclaimers and Limitation of Liability​

The platform is provided "as is," with no warranties. EnkorStay is not liable for any indirect, incidental, or consequential damages.

16. Third-Party Interactions​

The platform may contain links to third-party websites. EnkorStay is not responsible for the content or actions of third parties.

17. Termination​

The Company may terminate access to the platform at its discretion. Users must comply with any termination-related obligations.

18. Miscellaneous​

The Terms, along with supplemental policies, constitute the entire agreement between the user and EnkorStay.

19. Governing Law​

These Terms are governed by the laws of the Republic of Korea. Users agree to the jurisdiction of Korean courts.
